Guidance: Lender and Fiduciary Liability Amendments to Superfund and RCRA

This memorandum highlights the 1996 lender and fiduciary amendments to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund) contained in the Omnibus Appropriations for fiscal year 1997. Issued 10/3/1996.

As part of the Omnibus appropriations, Congress enacted the Asset Conservation, Lender Liability, and Deposit Insurance Protection Act which includes lender and fiduciary liability amendments to CERCLA, and amendments to the secured creditor exemption in the Resource Conservation and Recovery Act (RCRA).
