Guidance: Superfund Mixed Funding Settlement Evaluation
Memorandum provides guidance on use of mixed funding settlements under section 122(b) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund). The guidance is intended to encourage consideration of mixed funding settlements, present a method for analyzing the mix funding in the content of a settlement offer, and identify acceptable and poor candidates for mixed funding.
