Interim Guidance: Municipal Solid Waste Exemption under Superfund

Interim guidance discusses section 107(p) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund) and identifies some factors EPA and the Department of Justice will consider in exercising enforcement discretion with municipal solid waste (MSW) generators at national priority list (NPL) sites. This guidance supplements the 12/6/1989 and 2/5/1998 municipal settlement policy documents.
