Memorandum to EPA Regions on the use of an expedited settlement approach (ESA) for violations of the Chemical Accident Prevention Provisions of the Clean Air Act (CAA), 40 C.F.R.. Part 68. These regulations are also know as the Risk Management Program (RMP) for the Clean Air Act 112(r) requirements.
The memorandum:
- describes the kinds of violations that are appropriate for resolution with ESA,
- transmits forms for use, and
- amends the May 5, 2000 guidance.
