On June 3, 2020, EPA issued a No Action Assurance (NAA) setting forth the conditions under which applicable new industrial facilities would operate with respect to stormwater discharges in the period between the June 3, 2020 expiration of EPA’s 2015 Multi-Sector General Permit (MSGP) and the effective date of the agency’s 2020 MSGP(now referred to as the 2021 MSGP). The effective date of the agency’s 2021 MSGP on March 1, 2021 is two months later than anticipated when the NAA was originally issued. On January 19, 2021, EPA therefore extended the termination date of the NAA by two months from April 29, 2021 to June 29, 2021. All other requirements and conditions of the NAA remain the same. The eligibility requirements, conditions, and duration of the NAA as well as background information are set forth in the attached memoranda.
