Special Instructions: Colorado requires that Tier II reports be filed using EPA’s Tier2 Submit software and submitted to the Colorado Department of Public Health and Environment (CDPHE). Colorado has developed a platform, Colorado Environmental Online Services (CEOS), to handle a variety of environmental reporting requirements. Effective for reporting year 2017 (calendar year 2018) forward, Tier II reporting must occur through CEOS. CEOS will accept only validated T2S files. Visit CDPHE’s Tier II Exitwebpage for detailed instructions. Emailed reports will not be accepted.

Colorado has instituted a single-point submission process for Tier II reporting. Facilities are not required to provide the same report to the local emergency planning committee (LEPC) or the local fire department unless those agencies maintain local reporting requirements. Please check with your LEPC and fire district to determine if direct Tier II reporting to their agency is required. Tier II data submitted to the state will be distributed to the LEPCs and local fire districts.

Colorado has instituted several state-specific Tier2Submit requirements. These requirements are found under the “State Field” tab in Tier2 Submit. Please see Colorado’s Tier II Exitwebpage for information.

Special Instructions: Tier2 reports and fees are due annually by March 1.

Kentucky no longer accepts hard copy (paper) Tier2 reports or paper checks for associated fees!

On September 17, 2013, the Commonwealth Emergency Response Commission (CERC) Board of Commissioners met and unanimously passed Policy 003-2013.  Beginning January 1, 2014, all facilities within the Commonwealth of Kentucky, subject to Emergency Planning and Community Right-To-Know Act (EPCRA) sections 311-312, are required to file Tier2 reports and pay all associated fees electronically in accordance with KYEM's annually published "EPCRA - How to Comply Packet." Furthermore, those facilities that submit paper documents, either reporting forms or payments, shall have those documents marked "Return to Sender" and classified as non-compliant. If a facility remains non-compliant, they shall be subject to the maximum penalty allowable, as stated in KRS 39E.990.

KYEM annually updates the "EPCRA - How to Comply Packet," which includes step-by-step instructions required to be compliant with Kentucky and EPCRA regulations. This document will be available for download on the KYEM website listed above prior to the start of the reporting period, January 1st.

EPCRA allows the exact location of hazardous substances at a facility to be kept confidential. Facilities wishing to keep this information confidential must submit a hard copy of the Tier2 Confidentiality Form.

KY Tier II Confidentiality Form (PDF)(1 pp, 93 K, About PDF) Exit

Most, but not all LEPCs require electronic submission of Tier2 reports, a complete list of LEPC reporting requirements can be found on the website listed above and within the "EPCRA - How to Comply Packet." Fire Departments in KY still require a hard copy report.
