Oversight and Enforcement of Remaining Response Actions Under State Law Memorandum of Understanding
Transmittal memorandum and model Memorandum of Understanding (MOU) addressing the “transfer” from EPA to a state or tribe, for oversight and enforcement of remaining response actions under state law, of a post-enforcement, non-NPL Superfund site. This model MOU was developed under Superfund Task Force Recommendation 19.2. This model MOU and memorandum provide clarity on those factors to consider in determining whether such a transition is feasible and appropriate and described the process necessary to effectuate such a significant change.
