The Public Participation Process

Title V programs offer the public opportunities to participate:

  • Comment on and request a public hearing on draft permits,
  • Appeal Part 70 permits in state court
  • Petition the EPA to object to a permit
  • Appeal EPA-issued permits to the Environmental Appeals Board and federal courts
  • Track compliance by reviewing reports/certifications submitted by sources
  • Bring citizen suit in civil court for permit noncompliance

Petitions to Object to Operating Permits Under Clean Air Act Section 505(b)(2)

Any person may petition the EPA to object to certain Part 70 permits. Submitted petitions and EPA responses may be viewed at the EPA Title V Petition Database.
