Title I of the Clean Air Act requires state and local permitting authorities to adopt a preconstruction permitting program for the Prevention of Significant Deterioration (PSD) of air quality.

Approved/Delegated PSD Permit Programs

PSD permits are issued by state/local/tribal permitting authorities through either (1) an EPA-approved PSD program adopted under 40 CFR 51.166 or (2) a delegation of authority from EPA.

Tribes may, but are not required to, adopt their own PSD permit programs. Region 9 has not approved a PSD permit program or delegated PSD permitting authority to any Tribes.

PSD Permits Issued by Region 9

EPA is the PSD permitting authority in areas where an approved or delegated PSD program is not in place, including on Tribal lands. EPA issues PSD permits according to 40 CFR 52.21.
