General Information
EPA held an online public hearing about this proposal on September 12, 2025. The hearing convened at 9:00 a.m. Eastern Time (ET).
Oral testimony was limited to five minutes for each person. A verbatim transcript of the hearing will be included in the docket for this action when ready.
EPA will accept written public comments through Regulations.gov until the close of the comment period on this action, September 15, 2025.
EPA provided 30–days' notice of this public hearing. EPA evaluated the complexity and technical nature of the proposed rule. The scope of the proposed rule is limited to establishing an additional option for owners or operators of active CCR facilities or inactive CCR facilities with a legacy CCR surface impoundment to comply with the facility evaluation report (FER) Part 1 requirements and to extending compliance deadlines for the remaining CCRMU provisions published in the Federal Register on May 8, 2024. EPA determined these issues are not complex or highly technical and therefore 30 days' notice of the public hearing for this proposed rule was adequate to provide the public with meaningful opportunity to comment on the proposed regulatory changes.
