Proposed Approval
On June 4, 2026, EPA announced a proposal to approve the application submitted by the Louisiana Department of Environmental Quality for surface impoundments and landfills to allow the LDEQ CCR permit program to operate in lieu of the federal CCR program. EPA preliminarily determined that the Louisiana CCR permit program meets the standard for approval under the Resource Conservation and Recovery Act.
EPA will accept comments on this proposal through August 4, 2026.
Public Hearing
EPA will hold a hybrid in-person and online public hearing about this proposed approval on July 21, 2026, starting at 9:00 a.m. Central Time. The hearing will take place in person within the Galvez Building (LDEQ Headquarters Office) located at 602 North 5th Street Baton Rouge, LA 70802. Background
EPA received an application from the state of Louisiana requesting partial approval of their coal combustion residuals permit program.
In preparation to submit their application, Louisiana promulgated regulations for CCR disposal units into Louisiana Administrative Code (LAC) Title 33, Part VII, Chapter 10, which adopts the federal CCR regulations. In addition to the technical criteria, CCR units must comply with the permitting requirements in LAC Title 33, Part VII, Chapter 10, Section VII-1004, public notice and public hearing procedures in LAC Title 33, Part VII, Chapter 10, Section VII-1006, and enforcement requirements in LAC Title 33, Part VII, Chapter 10, Section VII- 1008.
