2009 cellulosic biomass ethanol RINs with a D code of 1 that are not used for compliance purposes in 2009 can be used to meet the cellulosic biofuel, advanced biofuel, and total renewable fuel RVOs in 2010. The 20% rollover cap will apply to 2009 RINs in this case per §80.1427(a)(5). 2010 cellulosic biomass ethanol RINs with a D code of 1 generated under RFS1 regulations between January 1, 2010 and June 30, 2010 can also be used to meet the cellulosic biofuel, advanced biofuel, and total renewable fuel RVOs in 2010.
