Virtual Public Hearing on the Revision of an Alternative Closure Requirement Deadline

On November 25, 2025, EPA announced a proposal to extend, by three years, a compliance deadline applicable to certain coal combustion residuals surface impoundments operating under the alternative closure provisions at Title 40 of the Code of Federal Regulations in Section 257.103(f)(2). In addition to accepting written comments, EPA will hold an online public hearing. The public hearing will provide interested persons the opportunity to present information, comments, or views concerning EPA's proposal.

General Information

EPA will hold an online public hearing about this proposal on January 6, 2026. The hearing will convene at 9:00 a.m. Eastern Time and conclude at 1:00 p.m. Eastern Time. If necessary, the hearing may go longer to accommodate all those wishing to speak.

Oral testimony will be limited to five minutes for each person. EPA may ask clarifying questions during the oral presentations but will not respond formally during the hearing to any comments or information presented at the hearing. A transcript of the hearing will be included in the docket for this action.

EPA will accept written public comments through January 7, 2026 through Regulations.gov.

Note: Do not present or submit at the hearing any information you consider to be confidential business information or other information whose disclosure is restricted by statute.
