Public Hearing on North Dakota's Coal Combustion Residuals Permit Program

On May 12, 2025, EPA announced a proposal to approve the application submitted by the North Dakota Department of Environmental Quality to allow the North Dakota Coal Combustion Residuals state permit program to operate in lieu of the federal CCR program. In addition to accepting written comments, EPA will hold a hybrid in-person and online public hearing. The public hearing will provide interested persons the opportunity to present information, comments, or views concerning EPA's proposal.

General Information

EPA will hold a hybrid in-person and online public hearing about this proposal on July 8, 2025 at the North Dakota Department of Environmental Quality building at 4201 Normandy Street, Bismarck, ND 58503-1324. The hearing will convene at 9:00 a.m. Central Time (CT) and conclude at 6:00 p.m. CT. If necessary, the hearing may go later to accommodate all those wishing to speak.

Oral testimony will be limited to five minutes for each person. EPA may ask clarifying questions during the oral presentations but will not respond formally during the hearing to any comments or information presented at the hearing. A verbatim transcript of the hearing will be included in the docket for this action. Speakers may provide oral testimony in person or online.

EPA will accept written public comments through Regulations.gov until the close of the comment period on this action.

Note: Do not present or submit at the hearing any information you consider to be confidential business information or other information whose disclosure is restricted by statute.

Registration

EPA will open registration for this free public hearing soon. Check back for the online registration link that we will post on this webpage.

If you would like to provide oral testimony during the hearing (either in person or online), please sign up by July 3, 2025. EPA may allow some or all persons to present oral testimony at the public hearing by registering the day of. EPA will consider such requests on a first-come, first-serve basis during the hearing as time permits

If you would like to attend the hearing, you can register via the link (coming soon!) above or at the registration desk the day of the hearing.

If you require the services of an interpreter or special accommodations such as audio transcription or closed captioning, please pre-register for the hearing and describe your needs on the registration form by June 24, 2025. Alternatively, registrants may notify Michelle Lloyd at lloyd.michelle@epa.gov of any special needs. EPA may not be able to arrange accommodations without advance notice.
