Public Hearing on the Proposed Amendments to the Coal Combustion Residuals Regulations

On April 13, 2026, EPA published a rule proposing several revisions to the existing federal coal combustion residuals regulations, including exempting CCR dewatering structures and modifying the beneficial use, legacy CCR surface impoundment and CCR management unit provisions. In addition to accepting written comments, EPA will hold an online public hearing. The public hearing will provide interested persons the opportunity to present information, comments, or views concerning EPA's proposal.

General Information

EPA will hold an online public hearing about this proposal on May 28, 2026. The hearing will convene at 9:00 a.m. Eastern Time and was originally scheduled to conclude at 6:00 p.m. Eastern Time. Due to high attendance, EPA has extended the hearing another hour (7:00 PM) and reduced the speaking time to three (3) minutes. Once the public hearing reaches capacity, you may still register to listen to the public hearing but will not be able to register for a speaking role. 

EPA may ask clarifying questions during the oral presentations but will not respond formally during the hearing to any comments or information presented at the hearing. A transcript of the hearing will be included in the docket for this action. 

EPA will accept written comments through the end of the comment period for this action through Regulations.gov at https://www.regulations.gov/commenton/EPA-HQ-OLEM-2020-0107-1376
