Background

EPA is currently reviewing an application to renew the Wayne Disposal, Inc. (WDI) landfill approval to dispose of polychlorinated biphenyls (PCBs). EPA regulates PCB disposal under the federal Toxic Substances Control Act (TSCA).

On November 5, 2021, Wayne Disposal Inc. (WDI) submitted a renewal application to U.S. Environmental Protection Agency (EPA) for the approval of a chemical waste landfill to dispose of polychlorinated biphenyls (PCBs). The application includes modifications to the landfill design including adjusting the liner grade, altering the final cover design, and altering the geometry of the final cover grade. These design modifications would result in increased landfill capacity.  The renewal and modifications would occur within the original boundaries of the facility located at 49350 N. I-94 Service Drive, Belleville, Michigan.

EPA and Michigan Department of Environment, Great Lakes, and Energy (EGLE) have conducted a technical review of the renewal application. WDI has responded to comments made by EPA and EGLE over the course of the technical review.

A draft permit is anticipated to be issued for public comment in Fall 2025.  When this occurs, EPA and Michigan EGLE will host a joint public hearing.

Permit History

The landfill has been permitted by EPA to dispose of PCBs since 1997.  The most recent PCB permit renewal was issued by EPA in 2019.  The landfill is also permitted by EGLE for the disposal of hazardous wastes. The most recent hazardous waste permit for the landfill was issued by EGLE in 2012.

In 2022, WDI received a major modification to their approval for a re-design of their liner system to incorporate Geosynthetic Clay Liner (GCL).
