Background

If approval is granted by U.S. Environmental Protection Agency (EPA), Wayne Disposal, Inc. (WDI) would be allowed to continue to dispose of polychlorinated biphenyls (PCB) in its hazardous waste and chemical waste landfill and modify the landfill design. The modifications would occur within the original boundaries of the facility located at 49350 North I-94 Service Drive, Belleville, Michigan. 

On November 5, 2021, WDI submitted a renewal application to EPA for the coordinated approval of a chemical waste landfill to dispose of PCBs. The application includes modifications to the landfill design including adjusting the liner grade, altering the final cover design, and altering the geometry of the final cover grade. These design modifications result in increased landfill capacity of approximately 5 million cubic yards, but do not change the facility boundary.

In 1997, EPA granted WDI approval to dispose of PCBs in the company’s chemical waste landfill. Permission to manage PCBs was last renewed by EPA in 2019. EPA regulates PCB disposal under the federal Toxic Substances Control Act (TSCA).

The WDI landfill is supervised by the Michigan Department of Environment, Great Lakes, and Energy (MEGLE) for hazardous waste disposal. The WDI landfill received its most recent state operating licence in 2012. EPA issues approvals for PCB disposal at landfills since states are not authorized to issue TSCA PCB regulations.

Because the landfill is permitted by both MEGLE and EPA, federal and state agencies are aligning the permit cycles for enhanced efficiency and to allow for joint communications and public meetings. 

After reviewing the renewal application from WDI, EPA tentatively plans to approve the draft application for a coordinated approval with modifications to the landfill design.  WDI has shown that the modifications are protective and do not present a risk to people or the environment.

Before a final decision is made, EPA is taking comments from the public on the proposed coordinated approval and modification for the disposal of PCBs at WDI located at 49350 North I-94 Service Drive, Belleville, Michigan.

The draft PCB chemical waste landfill coordinated approval is open for public comment from August 14, 2025 to October 31, 2025.

Copies of the draft PCB chemical waste landfill coordinated approval and supporting documents (i.e., WDI application) are located at the Belleville Area District Library as well as posted online (information below). Comments are being accepted on the draft EPA approval, not the supporting documents. Comments may be submitted online, using the comment form, or by email to either contact listed under “Contact Information.”
