Allowance Transfer Signatures

As of April 1998, allowance transfer requests can be submitted with only the signature of the authorized account representative for the transferor (seller) account if EPA already has on file the signature of the authorized account representative for the transferee (buyer) account. To file a signature, the authorized account representative for a transferee account should sign and submit to EPA the following statement along with a list of one or more accounts to which the statement applies. The statement may be submitted along with or in advance of a transfer request from the authorized account representative for the transferor account. Regardless of whether a future transfer request contains one or two signatures, EPA will continue to send both authorized account representatives transfer confirmation reports of any recorded transfer.

Statement to be Signed by Authorized Account Representatives for Transferee Accounts

"By this signature, I authorize any transfer of allowances into each of the Allowance Tracking System accounts listed herein, except that I do not waive any remedies under 40 CFR part 73, or any other remedies under State or federal law, to obtain correction of any erroneous transfers into such account. This authorization shall be binding on any authorized account representative for the account unless and until a statement signed by the authorized account representative retracting this authorization for the account is received by the Administrator.

I am authorized to make this submission on behalf of the owners and operators of the affected source or affected units, or on behalf of the parties having an ownership interest with respect to the allowances held, for which the submission is made. I certify under penalty of law that I have personally examined, and am familiar with, the statements and information submitted in this document and all its attachments. Based on my inquiry of those individuals with primary responsibility for obtaining the information, I certify that the statements and information are to the best of my knowledge and belief true, accurate, and complete. I am aware that there are significant penalties for submitting false statements and information or omitting required statements and information, including the possibility of fine or imprisonment."

Notes:

  • Because the signature requirements for transfer requests (and the contents of this statement) are the subject of an upcoming rulemaking that will clarify these signature requirements, EPA may revise the requirements, including the statement set forth here.  If the requirements are revised, authorized account representatives may be asked to resubmit the statement to reflect any revisions.

  • It is not necessary to submit the above statement if authorized account representatives plan to submit transfer requests signed by both transferor and transferee authorized account representatives.
