System Updates for Fuels Registration

Introduction

Version 2.1.0 of the OTAQ Registration System (OTAQReg) introduces functionality for complying with 40 CFR part 1090 regulatory changes.

40 CFR part 1090 (the “Fuels Regulatory Streamlining”) streamlines and modernizes EPA's fuels regulations under 40 CFR part 80, and generally replaces the gasoline and diesel subparts across 40 CFR part 80, including RFG, Anti-Dumping, ULSD, Sulfur, and Benzene requirements. The Fuels Regulatory Streamlining also includes updated regulatory text for Registration, Reporting, Attest Engagements and Sulfur / Benzene Averaging, Banking and Trading (“ABT”) regulatory provisions. The Fuels Regulatory Streamlining is effective on Jan.1, 2021, while the compliance deadlines mandated by the rule will come into effect throughout 2021 and 2022. Attest auditors and surveyors may begin to register in OTAQReg on Jan.1, 2021, and version 2.1.0 of OTAQReg introduces functionality to enable these registrations. EPA expects to implement additional OTAQReg functionality enhancements in 2021 and 2022 to enable parties to comply with regulatory deadlines. The RFS program requirements remain in 40 CFR part 80, subpart M. More information on system changes pertaining to the Streamlining Rule can be found at https://www.epa.gov/fuels-registration-reporting-and-compliance-help/system-updates-fuels-registration
