EPA's January 18, 2022 Final Permit
On January 18, 2022, EPA issued the final permit for the proposed construction and operation of South Fork Wind, LLC's offshore windfarm on the Outer Continental Shelf (OCS). The EPA considered all public comments submitted during the public comment period in its final decision-making process. EPA has prepared a Response to Comments document to describe and address any significant issues raised during the comment period, and to describe the provisions of the draft permit that have been changed and the reasons for the changes.

EPA's October 20, 2021 Revised Draft Permit
On October 20, 2021, EPA reopened the public comment period on a revised draft permit for the proposed construction and operation of South Fork Wind, LLC's offshore windfarm on the Outer Continental Shelf (OCS). EPA reopened the public comment for an additional 47 days to request comment on a revision to the draft permit that removes the requirement to obtain emission offsets for construction emissions. The revised draft permit maintained control technology requirements for OCS sources engaged in construction activities, and the requirement in the permit to obtain offsets for operational emissions remained unchanged as well. EPA also took this opportunity to correct typographical errors and include provisions that were inadvertently omitted from the initial draft permit. EPA held a formal virtual public hearing on the revised draft permit on December 2, 2021. EPA did not receive any verbal comments on the revised draft permit at the December 2, 2021 public hearing. EPA received written comments from three commenters during the public comment period from October 20 – December 6, 2021.

EPA's June 24, 2021 Initial Draft Permit
On June 24, 2021, U.S. EPA proposed a draft permit under the Clean Air Act (CAA) to South Fork Wind, LLC (SFWF) for the construction and operation of an offshore windfarm on the Outer Continental Shelf (OCS). The proposed windfarm will be located in federal waters in the Bureau of Ocean Energy Management (BOEM) Renewable Energy Lease Area OCS-A 0517 located southwest of Martha's Vineyard, Massachusetts. The EPA is proposing to issue the OCS air permit pursuant to section 328 of the CAA and applicable rules and regulations promulgated under 40 C.F.R. part 55. We are soliciting comments related to the air emission impacts and substance of the proposed CAA permit for the windfarm.
