Phase II Outreach

During the UNDS rulemakings, the EPA and the Department of War consult with interested state and local government representatives (“Federalism Consultation”), as well as federally recognized Tribes (“Tribal Consultation”). On March 14, 2013, and March 9, 2016, the EPA held Federalism consultations in Washington D.C. for Batch One and Batch Two, respectively. On March 26, 2013, and March 23, 2016, the EPA hosted meetings with federally recognized Tribes for Batch One and Batch Two, respectively.

Federalism consultations are required pursuant to the terms of Executive Order 13132 to allow state and local officials to have meaningful and timely input into agency rulemakings. Tribal consultations, as required under Executive Order 13175, facilitate government-to-government communications with Tribes to ensure early input and meaningful collaboration on federal policies that may affect Tribes.
