EPA Letters to California State Water Resources Control Board: Delegation of Clean Water and Drinking Water State Revolving Fund (SRF) Programs

EPA has delegated administration of the Clean Water and Drinking Water State Revolving Fund (SRF) programs to states under the federal Clean Water Act and Safe Drinking Water Act to assist in funding projects intended to improve water quality and protect human health. State agencies administer the Clean Water SRF program pursuant to 40 CFR Part 35, Subpart K and the Drinking Water SRF program pursuant to 40 C.F.R. Part 35, Subpart L.

The California State Water Resources Control Board (State Water Board) has been delegated implementation of the Clean Water and Drinking Water SRF programs in California.

The National Environmental Policy Act (NEPA) requires federal, state, and local public agencies to conduct environmental reviews for projects receiving federal assistance. NEPA requires environmental reviews, the circulation of documents to the public and other participating agencies and requires a comment period. The California State Environmental Review Process is designed to meet the environmental review requirements of the Clean Water and Drinking Water SRF capitalization grants through a NEPA-equivalent process, using the California Environmental Quality Act as its basis.
