Summary

The United States Environmental Protection Agency (EPA) is announcing its decision to issue a CAA title V reopened operating permit for the Harvest Los Mestenios Compressor Station (Facility) in accordance with 40 CFR §§ 71.7 and 124.  The Facility is located on the Jicarilla Apache Nation (JAN) Reservation in the northwestern quadrant of New Mexico, approximately 24 miles northwest of Gavilan, New Mexico in Rio Arriba County. The Facility has been in operation since the late 1960’s as a natural gas compressor station that accepts produced natural gas gathered from various wellheads in the gas fields surrounding the Facility and compresses this gas for delivery to natural gas processing plants. 

EPA narrowly reopened for cause the Facility’s title V renewal permit that was issued on June 28, 2024, to address certain permit terms that contained either a material mistake or inaccurate statements. According to 40 CFR § 71.7(f)(1)(iii), issued operating permits shall be reopened for cause if the permitting authority determines that the permit contains a material mistake or that inaccurate statements were made in establishing the emissions standards or other terms or conditions of the permit. The following changes were addressed in the reopened permit:

  1. To correct the Title V permit to exclude certain emissions limitations and associated monitoring, recordkeeping, and reporting (MRR) requirements.
  2. EPA will revise “Table 1: Part 71 Permit History” in Section 1 by removing existing references to the 1996 Permit as forming the basis for renewal. 
  3. Table 2 in Section 1 to note that only the Solar Saturn Turbine and emergency generator are regulated emissions units.
  4. Section 2 and Table 4 to note that only emissions of NOX, VOC, and CO from the Solar Saturn Turbine have regulated emissions with enforceable limitations on their PTE. Clarify that for all other emissions units, the potential to emit was “unregulated” and “for informational purposes.”
  5. Removing the Emission Unit Specific Requirements for the Condensate Storage Tanks (T1 and T2) in Section 6.3, truck loading (L1) in Section 6.4, planned startup, shutdown, and maintenance (SSM) activities in Section 6.5 and piping, valve and flanges equipment leaks (F1) in Section 6.6.

EPA prepared the draft reopened for cause permit for a 30-day public comment period from September 4 through October 4, 2025. EPA also offered the public an opportunity to request a public hearing. There were no requests for public hearing received during the public comment period. Also, there were no written comments received during the public comment period. 

After consideration of the pertinent Federal statutes and regulations and additional materials relevant to the application contained in the Administrative Record for this permit action, the EPA is issuing the final reopened for cause title V operating permit for the Facility. All documents relevant to EPA’s decision regarding the Facility’s reopening for cause title V permit are available through the online docket at www.regulations.gov, docket identification number EPA-R6-OAR-2025-0220, including the Basis for Decision to issue the final permit and the final title V reopened operating permit [40 CFR § 71.11].

Since no comments were received on the reopened for cause permit during the public comment period, the final title V permit for the Harvest Los Mestenios Compressor Station will become effective immediately upon issuance [40 CFR § 71.11(i)(2)(iii)].
