ANNOUNCEMENT OF FINAL PERMIT DECISION TO ISSUE FEDERAL MINOR NEW SOURCE REVIEW PERMIT

The U.S. Environmental Protection Agency Region 6 (EPA) is announcing its decision to issue a Minor New Source Review (NSR) permit in accordance with the provisions of the Clean Air Act (CAA) and the Federal Minor New Source Review Program in Indian Country, 40 CFR § 49.151 - § 49.161, to the Choctaw Nation of Oklahoma, for the Choctaw Nation Headquarters Campus. The existing facility is located on the Choctaw Nation trust lands in Durant, Bryan County, Oklahoma.

The EPA prepared a draft permit and held a public comment period from March 15, 2023, through April 14, 2023. The EPA also offered the public an opportunity to request a public hearing. No public comments nor requests for a public hearing were received during the comment period.

EPA informed the Chickasaw Nation of Oklahoma of our proposed permit action, as it is the only tribal nation within a 50-mile radius of the Facility’s proposed permit action. The notification was sent thirty (30) days prior to the public comment period. The notification letters, dated February 13, 2023, included an invitation to the Chickasaw Nation for government-to-government tribal consultation, if the Chickasaw Nation so chose. It was outlined in the letters that this invitation would continue through the thirty (30) day public comment period. EPA received no request for government-to-government tribal consultation during this sixty (60) day period. Therefore, the end of the public comment period on April 14, 2023, closes out the tribal consultation period for this permit action as well.

There have been no substantive changes in the draft permit prior to the final permit issuance. All emission rates and standards remain unchanged from those presented in the draft permit that was public noticed. 

The final permit will be effective immediately upon issuance pursuant to 40 CFR § 49.159(a). The final permit, basis of decision, and other key documents relevant to this permit action can be found in the Docket ID No. EPA-R06-OAR-2022-0945 at www.regulations.gov.
