Description of Business or Activity Conducted by the Respondent: Respondent owns and operates a trucking facility located at 1576 State Highway 36, Fortuna, California, which engaged in hauling raw milk from dairy producers to processing facilities and continues to engage in transporting logging materials.
Summary of Alleged Violations: Respondent’s trucking facility in Fortuna, California was involved in three separate incidents of Respondent’s tanker trucks overturning and discharging raw milk into Waters of the United States. On January 19, 2020 a tanker truck owned and operated by Respondent was carrying raw milk on Highway 20 near Glenhaven in Lake County when it overturned down an embankment and released raw milk into Clear Lake. On April 12, 2020, a tanker truck owned and operated by Respondent was carrying raw milk on Highway 20 near Clearlake Oaks in Lake County when it overturned down an embankment and released raw milk into Clear Lake. On December 11, 2021, a tanker truck owned and operated by Respondent was carrying raw milk on Highway 20 east of Lance Road in Lake County when it overturned down an embankment into Grizzly Creek, a tributary of Cache Creek.
