Agency for Toxic Substances and Disease Registry (ATSDR) National Priorities List (NPL) Sites
Section 300.425(c) of the National Contingency Plan (NCP), the Federal regulation by which CERCLA is implemented (55 FR 8845, March 8, 1990), allows the listing of a site due to an Agency for Toxic Substances and Disease Registry (ATSDR) health advisory, without the need to apply the Hazard Ranking System (How Sites Are Placed on the NPL).
For a site to qualify, all of the following conditions must be met:
- The ATSDR of the U.S. Public Health Service must issue a health advisory that recommends removing people from the site;
- EPA must determine that the site poses a significant threat to public health; and
- EPA must anticipate that it will be more cost-effective to use its remedial authority (available only at NPL sites) than to use its emergency removal authority to respond to the site.
